  • Advice Needed

My mom's visitor visa was rejected twice in the last 3 yrs because she is a widow. Now I have got my US citizenship and can apply for her GC which can't be denied.

I am thinking of asking her to try third and last time for visitor visa and this time I want to write in the covering letter to VO that though I can apply for her GC I am not doing it for now because its an overkill as she has absolutely no intentions of settling in US. All she needs is a tourist visa to visit me for a couple of months and if she is denied then I will have to apply for her GC.

Do you think the above letter will harm her GC process later on (in case her visitor visa is denied again) because they may say she wants to use her GC as tourist visa and she has no intentions to become a permanent US resident?

    Ideas and suggesstion welcome.

    Oooooooooooops!

Nope, not at all. If you have any plans of filing for her permanent residency, they will not be inclined to give her a visitor visa.

I understand your situation and agree with you on the logistics. However, AMCON officials don't do this math, they just go by the book (most of the time).

You can go ahead and sponsor her for yet another visitor visa. Do send a cover letter indicating that you're an US citizen and provide your financial documents.

Good luck to your mom, hope she gets the visa.

I was in the same boat - but my mother got visa

      rcmax,
I was in the same boat a month ago. My mother is also a widow visited US twice before, both sons live in US, no more children in India and her visa got rejected twice. I am USC aswell but wanted to try one more time. So this is what I did this time.
      1. contacted a local senator with all my mother's details. His office sent an email to Chennai consulate with the details.( I tried this twice once for my In laws and once for my mother and both times it worked
      2. Wrote a clear letter to Consulate saying I am not applying a GC for my mother as she is not interested to settle in US, but she wanted to have a quick visit to see her grand children. I also mentioned in the letter that she has to take care of her old parents in India.
You have to make sure your mother gives that letter to the VO at the Interview counter not at the first counter.

One other thing make sure you change the documentation little bit (affidavit etc..) if you are trying again...

btw..she got 10 yr multiple visa this time.

good luck..your mother will get it this time.

Saying the same thing in different words help

Don't say, "If you don't giver her visa, I will have to apply for her GC".
Say, "I am not sponsoring her green card because she is not interested in staying US permanently. Therefore, give her visa."

          gcformom and immihelp,
thanks for your inputs. gcformom, I have a question for you. Did you send a copy of the same letter to senator's office that you sent to VO in which you stated you are not applying for GC for mom as all she wants is a quick visit?

I did contact the senator's office the second time when I applied for my mom's tourist visa in 2006 and his office sent a letter to Chennai consulate but it did'nt help. Maybe this time the letter I will write to VO explaing why I don't want want to apply for her GC may do a better job to convince him.

            rcmax,
I have not sent the letter to senator's office.
You should write a letter to VO why you are not applying her a GC and why she is not interested( family ties in India etc..) and make sure the VO reads the letter.
Also, I assume you are applying for visa this time after becoming USC, so that is a change from last time.

            good luck..
