  • Typical Situation.. Please help...

    Here is my case... very unnnatural one.. but this happened...

    While filling my 10th standard exam form, one of my cousin brothers, with whom I was staying, wrote my father's brother name as my father name. Because I was staying in their house. It is continuing in all my certificates and the same came to my passport. As far as certificates and passport are concerned, it is fine. But now I want to bring my parents to USA on visit. In all my documents my father's brother name is there as my father and his wife as my mother. I am in confusion what to do and how to go further.
    Do I need to make any affidavit or how can I bring them here? Please somebody help as it is little urgent.
    I don't know the process of changing father and mother name in all my documents and passport and it is a time consuming process I guess. Somebody please help me..

    I am sorry it is not a typical situation but very atypical. Typical means commonly found.

    I am surprised you went on without getting such a big mistake corrected at a much earlier stage. And how were you able to advance in your career (college student , job ) without such an error creating a problem?

    What is your visa status in US?
    Do you have a birth certificate with your name and correct names of both your parents?

      Consult a good lawyer in India and attorney in the US before you do anything

      Hi Sekhar
      Before you do anything, please consult with a good lawyer (in your own State in India) and also consult good attorney in the US. You need good reliable legal advise before you make any changes to your documents.

      In Passport, I think you should be able to make this change - if you have court order from executive magistrate in your local Court - they may ask for legal proof as in Birth certificate - I am not sure but there must be a procedure if you can legally substantiate your case.

      But if you get a new passport, then what happens to your visa stamps? You need to check with consulate about getting restamped in new passport (and may need to explain why new passport, etc) - and also need to retain old passports anyway.

      I dont know which other documents in US will be affected by this.



      Please do not initiate any changes without solid legal advise.
