  • Urgent 2nd time travel- how long will the I-94 be?

    My Parents are planning to go back in November 1st week and come back after 3 months in Februray. How long will the I-94 be given for? This is urgent as I need to decide if the extension has to be applied for or not. Please help

    That is at the discretion of the examining officer at the POE. He may give them 6 months, he may give them 1 month. It depends on how well your parents prove the reason to come to the US. Definite plans.

    I advice you against filing an extension. First, you must file an extension ONLY when something that you did not expect occurs. Such as an accident, a pregnancy, anything that was not expected and thus you must extend your stay.

    Applying to extend your stay, is a risk. If denied after the I-94 expiration date you are out of status and your visa may become void. All depends on the POE interpretation of 222(G).

    You should not apply to extend the stay "just because they want to visit longer". It is a risk. You should not even be thinking about it, because as I said, it is only when something unexpected/unplanned happens.

      Only after they came here I knew that I was pregnant. But I want them to be here for delivery and also till the bay is 5 or 6 months old. That is the reason. They can go back early now in October end (4 months stay duration) and can come back for delivery in february. Would the chances for getting 6 months on the 2nd trip be high?

        If they have to come back in February, why are they leaving at the end of October? Why can't they leave at the end of September or for that matter in the middle of September?

        Tickets can be changed/preponed, you know.

        That way they would have stayed for around three months. That means they stand a better chance of convincing the Immigration Officer to give them a longer duration of stay on the I-94 during their next trip.

          If they leave at the end of September then they would have stayed for around three months.

            No... Reason is that they need to attend a wedding here on Oct 28th.
            Thats why I thought they can leave by Nov 1st week
