  • Visitor visa for Wife's Parent

    Hi there,
I am a US citizen and married a girl from India on a K-1 fiancee visa. Wife is currently going through adjustment of status process and will get green card hopefully this year. It has been 2 years and she is still waiting to get her green card and missing her parents.

Her parents applied earlier when her tenure in US was only for 3 months, Their visa was rejected. I have a question that should her parents reapply for Visitor visa again or should they wait till she gets her green card. Would having Green card increase the chances that US embassy will approver her parents visitor visa?

Please advise... (Thanks so much in advance).

Your wife getting a green card has NO POSITIVE effects on her parents getting a tourist visa.

Her parents MUST overcome 214(b) on their OWN MEANS. Please refer to: http://immihelp.comhttps://www.immih.../overview.html

If anything it will be even harder for them to obtain a visa once she becomes a Resident and A LOT harder when she becomes a US Citizen (since she will be able to petition for her parents as immediate relatives for a GC).

I guess she is stuck in namecheck?

Have you considered traveling to India? (she can use Advance Parole - I131) to visit them.
