  • Visitor Visa- return back to US in 1month duration

    Hi,

    My parents have come to US for the first time and they stayed here for 6 months and are going back in Oct. As my wife's delivery is due in Dec, We need my parents to come back in a month's duration.

    I would like to know the chances of approving their entry into US and the duration they could stay in US, as people are giving different opinions saying their entry might get rejected/ they will get I-94 validity only for one month etc.

    Appreciate responses from Senior members like Subramanya.

    They have already spent 6 months of this year in the USA. They can not expect to spend another 6 months... that is not the right use of a tourist visa, as they are "living" not "visiting" the USA.

    I think they have a very slim chance of being granted entry and if they do, they will get a restricted I-94 of 1 month or less.

    The officer at the POE will definately make the decision, but if the purpose of the visit is "Caring" for the mom and baby that is considered working. That is not a purpose for which they will grant another 6 months.

      you needed to plan better, if you found out that wife was pregnant and wanted to have your parents around you should have sent them back early and then have them over without any problem at the time of delivery.

      Taking care of mon n baby can be work but being present for your grandchild's birth is a family activity allowed under visitor visa.

      My advice would be to get your in-laws in this time and have your parents come in later if possible. The risks are too great for denial or short stay.
