Valid Renewed Visa But Expired Visa Stamping

Hi,
I want to sponsor my mom for visitor's visa. I have done my Masters and have a vaild H1B visa. I renewed my passport in Sept 07, but my old passport contain my first 3 year H1B visa stamping, which ended on June, 07. I have another valid 3 year extention (I-797) that expires in end of 2009. My I-94 expires in April, 08. I wanted to get my passport stamped before I apply for my mom's visa, but I am not getting appointment in Canada for next 6 weeks.

Can I apply for my mom's visa given my situation? Essentially my question is, since my visa stamping is expired in my passport, but still I have valid new I-797 and I-94, can I send those documents for support of my mom's visa? Please reply.

you dont need to have a stamp but th approval of extesion is enough

Thanks for your reply waitin_toolong. This is what my understanding was, wanted to confirm on the forum. Also, I am not having any luck with Hindi / Gujarati interpretor visa appointments in Mumbai. It says, keep checking. Any ideas how so many people are getting visa appointments and how can I get one for my mom?

You have no other option except to keep trying, generally on thursdays and fridays (but not every) they are opening slots for regional languages.
