  • My visa was shortened

I've got my visa from 2004 to 2014, my boyfriend who was born in u.s. invited me to spend a couple of months with him in new jersey, he paid my air ticket and when I landed in houston on oct 19, I was caught by the inmigration department cos they said I could not be eligible cos I didn-t have enough money to pay for my stay, and I had quit my job in argentina. After several hours they let me demonstrate I've worked all my life in argentina and I-m 39, but I can get a job back as soon as I get back. What's more my son who is 18 is in Argentina and he doesn-t even have a passport, and I have a property over there, so it's clear I need to get back.
They called in my b/f and he told them he had invited me and he's in charge of my stay, they asked questions to us in a separate way and we replied the same, after they inspected all my lugagge they allowed me to stay for only one week.
My original flight was schedulled to get back on Jan and we tried to get a flight on or before oct 26 but the price difference was u$s1100 so we booked a returning flight on oct 28 cos the price difference is u$s 100 instead, but it's 2 days later.
The issue is that before the inmigration authorities, I recognized this american guy is the reason of my trip, we wanted to spend a couple of months together including xmas and new year and my return was schedulled to be back right on my son's bday, but it seems we can't ...... ok
Anyway the main concern right now is that I can get back two days after the allowed week, and i don't want it to be a problem. I was told my visa will immediately be removed and I won't be able to get back for 3 or 5 years.
Another important thing is that I can attach an email demonstrating I can get a job whenever I get back to Argentina. I enjoy my life in Buenos Aires and everything is under control over there while I'm away. I just love this american guy.
What can we do? Can we apply for an allowance extension? We are quite short of time even to claim for justice.

You should not stay in US past that one week you are allowed to stay.

Looking at your circumstances, even if you apply for extension, it might most likely be denied.

But what can I do? We do not have the $1100 to buy a ticket for a flight before the deadline date of Oct. 26th. The only ticket that we could afford (we had to pay an extra $150.00)was to change my ticket departure from Jan. 8th to Oct. 28th, which is 2 days after the deadline. What if I were to go to the airport on Oct.26th and wait at the customs office until my plane leaves on Oct. 28th? I do not want to break the law, but I just can't afford the earlier plane ticket. Thank-You for any help you can give me.

First of all, my apologizes for posting again, but I'm still trying to find a way to avoid further trouble, eventhough I can't leave New Jersey before 2 days after the req. date. I spend hours unsuccessfully trying to make it right.

I still wonder what's so wrong regarding my situation, (I love him but I can also show ties to my birth place).
        Once again, thanks in advance

Law and affordability don't always go together.

If you stay past your I-94 date, you are staying illegally in US and that would cause you future trouble traveling to US or even getting visa.

I feel really bad to hear about your situation. In the worst case scenario (in case you just can't get your stay extended by the immigration authorities), I wonder if you could get to the airport late night of the last day of your stay and go through the immigration and wait at the terminal for a day.. Maybe that way you'd have the cheaper ticket but won't be over-staying in USA.

I'm back to this board cos I can't leave without thanking the site for letting me focus con what I had to do. I called in everywhere, finally, I am taking a flight today without paying more that the additional 150 that was already paid, so I will leave right on the date. About the marriage option, I'd love to marry this man one day but not under these circumstances. Bye
