Hi,
I am writing on behalf of my friend..
He is a doctor and Canadian permanent resident and lives near US border. He held a B1/B2 for US. A doctor just across the border allowed him to Observe under her to gain some experience. This is something indian and other foreign doctors do all the time on a visitor visa. Rather this kind of experience is the most favored by US residency programs.
Now since the US doctors office was about 90 mins drive from his place he decided to drive to US everyday. The first day he showed his documents at the border and asked them if he was okay. They said it was and he did it for 4 days. Everyday they checked his documents and allowed him.
On day 5, they stopped him while entering US. They questioned him and accused him of practising in US illegally. He showed them the letter from the supervising doctor and told them that he had asked this thing the very first day too. But the officer was not ready to listen anything. He said he was doing it illegally and it wasn't allowed (when actually IT IS legal and all foreign doctors do it and gain entry at the port of entry solely for this purpose). He also abused this guy and asked him to sign a paper that he was satisfied for the reason for his cancellation. This doctor refused because he was baffled and far from satisfied. He requested the officer to call up the doctor and confirm that he was simply observing under her supervision but the officer said he didn't have time for all this ****. They searched him and his car thoroughly and couldn't find anything suspicious except his stethoscope which they alleged, he used for practicing illegally!
Anyway, finally he cancelled his visa.
Now my question is that is there a redressal system for such situations. My friend wasn't doing anything wrong or illegal. We know he can apply again but now the chances of rejection are very high. His whole career could be destroyed by this incident if that happens.
What should we do now?
