  • Mother visa rejected 3 times

    My mother visa got rejected 3 times in 2006.The last time she attended interview was December 2006.I am planning to apply again in Jauary 2008.Do i have to wait some time or can i apply right now(for January)?
    My mother is widow,she is working in government company.She has 6 years of service and my brother is working in MNC company.The first time the VO officer said my brother might go to USA with H1 visa because he is hightly educated.To tell you the truth,my brother didn't have any intrest to come to USA.How can i prove to the VO officer that my brother is single,working in india and no intrest to come to USA?Please advice....

    Need more info please;
    What is your visa status in US?
    Did you send an I-134 on your mother's previous attempts ?
    What is your mother's annual income in India? And what is your brother's
    annual income in India?
    Does your mother or brother have any property in India?

      I have green card.yes,I did send I134 to my mom in all attempts.
      My mom income is around 2 lakhs per year and my brother salary is 5 lakhs per year.
      Yes,There do have agricultural land.
      I am planning to send her again in march.
      Please advise,how i could prove that she is not potential immigrant.

        The negatives in her case are;
        *She is a widow. Widows traditionally have a hard time getting a visitor visa. A life partner in India is a strong tie to India and increases the chances of visa success considerably.

        *Her income is too low to show strong ties to INdia.

        *Their income is not enough to show self financing of your mom's trip, which could obviate the need to send an I-134 and would increase her chances.
        (Self financing shows that the applicant is not dependent on the host in US
        so is less likely to stay back in US). Rs one lac per month of total family income could qualify her for self financing.

        Does she have any income from her agricultural land?

        What she could do is prepare a cover letter and hand it over to the officer right at the beginning of the interview.
        She should mention the reasons why she would return to India;

        *Her son is here and show any evidence that he is not interested in going to US ( eg permanent job letter)

        *Mention that even if she has a low paying job but she has strong assets; their house property if any, details about her agricultural land and show how much it is worth. Show market evalutations and original papers. Show her savings, fixed deposits, provident fund, insurance policies, worth of land on a CA's paper
        and show a big figure in lacs at the bottom as the TOTAL WORTH OF ASSETS. Mention that she is managing the land and her son is too busy to manage it.

        No guarantees but no harm in trying this way.

            My mom is going for an visa in March let me see my luck this time.How can i prove that my mom is not an potential immigrant.Last few times they didn't even ask single question.How can she even talk and convience VO.My mom is going for an visa after year and 3 months from last rejection.Does she has more chances to get visa.I have one question reagrding,if Vo ask about why did you try visa from last year?The honest reason is we would like wait and prove that my brother is still in India and never applied for H1 and he working full time in Banglore.Can we say that answer.Please advice.

              They assess if the person is "potential immigrant" from one's situation.
              No convincing works.
              Widows they ususally take as potential immigrants unless they can show strong financial ties in India which your mother does not have.

              So, your focus this time should be opening the case with strong financial statements ;
              "I was denied last time because I am a widow, but I have a good financial
              base in India ( agricultural land, show CA's letter showing net worth)
              and my son who is committed to staying in INdia ..show permanent job letter). I only wish to visit my child in US for 2 months."

              DO NOT ANSWER ABOUT YOUR BROther LIKE YOU MENTIONED.

                Is total 50 lakhs worth of property and money proves better finacial ties in India?My mom invested money in private finance,Is this count in the net worth.
                She has public notary that she invested money with the finacial company.
