  • I-94 exceeds Visa with Annotation

    Today is Dec 19th. I have an I-94 that states that I must depart by June 14th, 2008. However, on my visa, it gives an annotation that says "traveling to visit sister in Dallas, TX December 15, 2007 - January 16, 2008".

    I have talked to two different people with the department of state that have given me different information on what the controlling document is when you have a visa with an annotation.

    One man told me that the I-94 is the controlling document and unless there is an annotation on the *actual* I-94 I can stay as long as it says. A woman told me that the annotation on the visa supercedes the I-94.

    Which is correct?

    Will I have difficulty getting another visa if I stay longer than the stated annotation on the visa?

    legally you are allowed to stay till the I-94 allows.

    But you might be accused of false representation if you ever go for visa renewal later. So make your judgement accordingly.
