    This is my situation and I badly need some advice...

    I am from India and I have custody of my 9 y.o. son. We
    were in the US to visit my brother who just married a US citizen abt a year
    ago, (she is orginally from India but was recently granted US
    citizenship). My brother is in the process of getting his green card.

    During the visit, I fell in love with an American lady and we would like to
    get married. I returned back to India and now I am trying to search
    for the best and quickest way to get back to the US so we can marry. I
    checked into some schools during my visit to the US but found it to be
    too expensive to take upon schooling. I wouldn't go for the student
    visa unless that is the only choice.

    Would my brother be able to sponser me and my son? Could my son
    and I get a family based visa even though my brother is not a US citizen
    but his wife is? How long is this process?

    Then about the fiancee visa, it says that it takes 6 to 10 months
    to process. Is there anything that could be sooner than a 6 - 10 month
    wait? Would applying for a fiancee visa put my son and my 5 year
    multiple visitor visa in jeopardy? Would it be quicker and possible if
    either my fiancee or I visited as on a visitors visa and then got
    married? Would we have to separate and return to our country after the
    marriage until the proper visa/paperwork is granted or would I be
    automatically granted a green card and work permit on the day of
    marriage if we married in India or in the US? Please respond ASAP...

    Your brother can not sponsor your as a permanent resident. His wife can not sponsor you at all.

    The best and fastest way will be a K1 (fiancee) visa. There isn't any other way.

      If I enroll as a student and get a student visa... then if we continue to date and find that we want to marry and get engaged... if I get married by the time I am finished with school, can I change my status and not have to go back to my country to fill a F3? Let me know...

        You can get married at any point, not having to finish your studies (though it is recommended) and change your status to permanent resident, without having to go back to India.
