  • B1 Visa rejected!!

    hello help,

    My father attended B1 visa today in chennai. He is 70 years of age. My brother and I am working in US. My brother is sponsoring for my fathers' trip.

    after couple of basic questions....

    Officer: where is your second son?
    My father: he is in india working in a xyz software company.

    Officer: Why are you hiding the fact that your second son is in US. And also he said "your wife went to US and stayed one year on B1 visa by applying extension. If you go to US, you may not come back to india. So i am not giving the visa to you."

    I heard couple of instance from my friends that their parents said that second son is in india (though 2 sons are in US) and got visa. so i told to my father that don't tell that that i am in US.

    And my mother got her visa 2 years back. She came to US and stayed one year by applying 6 months extension for emergency need.

    I wonder how would visa officer know all these things? we didn't mention about my mother and me in application form.

    Is there any second chance of getting the visa again? if there is, when will we apply for the interview again?

    your father LIED to an immigration officer, in order to gain a benefit... That gives him an eternal ban from ever entering the USA...

    That is why it is a BAD idea to lie... USCIS has more information than you think... I am sorry for your dad, but I would not advice him to try again for at least 2-3 years. That is if he was not red flagged and marked in the system already as a banned for life.

      we realized our mistake. next time we never do hide the facts.

      They rejected my dad visa under section 214(b). My father inquired with one of persons who works in visa office. he said he can attend the interview any time again. we are planing to book the slot after one or two months.
      2/3 years is too long for him as he is 70+ now. he has very strong desire to see Niagara falls. he just need 6 months visa to cover important places in US.

      Could you please let me know your thoughts?

        His apparent reason for rejection will be: "failed to prove strong ties to home country".

        It advice waiting more than a few months, because at the next interview whoever will interview him will very likely bring up the "lies" of the past interview. Giving it some time, may make it better. But it is up to you.

          I am glad the visa was rejected Get some moral and ethical values first. Ever imagined how embarassing your 70 yr old dad might have felt when he was caught lying red-handed in a hall full of people? B'coz of ppl like you many other elders face a problem in getting a visitor's visa.
