  • Important Info regarding I-539 extension applications

    Hello Everyone,

I just found out some information regarding extension of visa applications which may affect people who have filed their application and are not receiving a decision from the INS before the expiry of their scheduled stay.

As it says in the below mentioned article, the INS has revised it's rules with section 222(g) due to the enormous delay in processing times. The original Section 222(g) states that a visa is void if the immigrant stayed in the US past their I-94 expiration date. Now the INS has revised that rule stating that IF your application for extension was filed in time and your application is pending as of the date your i-94 expires[/B], you are authorized to remain in the US until you hear from the INS and the your visa is no longer void. Please refer to teh following link to get more specific info

and teh discussion forum where I found it. For some reason this forum will not accept the URL name so I have deliberately misspelled the word portal. Please type in teh correct spelling of portal where the stars appear.....

I would appreciate it very much if teh senior advisors on this forum took a look at this information and posted their comments.
