    Hi Folks,

    My Parents got visitor Visa stamped for 10 years multiple entry, and they received the passsports. Next day they received call from chennai consulate that they had problem in the finger printing, and asked to reappear for the visa along with all the documents, passports, DS-156,157 forms, as well the photographs.

    And they were asked several questions about me and my education since schooling till college, where I have studied, what I have studies ( I have come to USA on F1, and then got my H1 and have been working here since 1.5 years). VO checked and asked questions about each and every paper submitted by me and my parents and finally cancelled their visa.

    The whole process took from 8.30 am till 5.00pm, with several intervals and waiting time in between. And they were questioned and moved to different Windows and officers.

    My documents - H1, paystubs, W2, affidavit, bank statements everything is clear and not had been falsified in any part of my paper work.
    My Dad submitted his NOC(No objection certificate from office, leave sanction letter, bank statements and property statements as well affidavit) which has not been falsified either in any aspect.

    Two things - I didnot disclose that I am expecting, and we didnot disclose that my Dad has a brother in USA (since he is a citizen and he settled here with his family). I thought they might lessen the chances for them to get the Visa

    Apart from that, nothing has been falsified.

    VO asked if they really have any daughter in USA, for which my parents submitted my original DOB certificate. Then they checked my parents documents, and questioned about each and everydocument and finally said that they are cancelling the visa, and that they can reappear for the visa with proper documents next time. I didnot get what kind of proper documents is the VO looking for? VO told them that my parents will receive a letter from the consulate too. Other than that they didnot state any reason for rejection.

    I am wondering, what made the Chennai consulate to ask my parents to reappear for the visa, and what made them to cancel the 10 years visa which they approved.

    Please advise, and what to do as my next step to bring them over here

    The DS 156 specificall asks if the visa applicant has a brother or sister in the US and if they are a LPR or citizen.

    Did you really think that it was OK to lie about your dad's brother being a citizen? It was a really BIG lie!

    Quoting from the form:

    " 41. I certify that I have read and understood all the questions set forth in this application and the answers I have furnished on this form are true and correct to the best of my knowledge and belief. I understand that any false or misleading statement may result in the permanent refusal of a visa or denial of entry into the United States. ...... "


    YOu father signed that he told the truth but had not. Their visa might have been granted if they had told the truth; why should the visa officer believe them if they reapply.

    As it has been said many times: DO NOT LIE IN ORDER TO TRY TO GET A VISA. You'll get no sympathy from me.

        From your post, it seems that they suspected you were not the applicants'
        daughter. That is why they asked detailed questions about your past,
        and "if they really had a daughter in US".

        The reason they suspected this could be due to your lie about your uncle.

        I guess it is going to be very hard for them to get a visitor visa in future.

          Did you **** any documents when you applied for student's visa, years ago?
          And yes, you really should not have lied about ur dad's brother. If, by any means, they come to know about it, your parents will be banned to even apply for a visa for the rest of their lives.

            The processing done behind the scenes is far more effective than before. Previously, many applicants got aways with lies on siblings living in the USA. However, its not the case now. More thorough checking is being done and any un/intentional mistake can result in grave result. Be thankful that the VO told them to reappear with the proper document instead of barring from re-entering USA forever. I hope they get the visa next time without any hassles...

                I did not find it weird and scary. Did you not find applicants giving incorrect information on the application weird and scary? Thats weird and scary to me.

                As for your freind: 212(a)(6)(C)(i) states:

                (i) In general.-Any alien who, by fraud or willfully misrepresenting a material fact, seeks to procure (or has sought to procure or has procured) a visa, other documentation, or admission into the United States or other benefit provided under this Act is inadmissible.

                  What kind of visa did he previously apply for? Unless a waiver is sought under 212(d)(3)(A) , there is no point in applying as misrepresentation is grounds for inadmissibility on a permanent basis.
