  • B2 for brother rejected - 124-b

I am a perm resident. My son, 5 yrs old, (USC) has gone to India with my in-laws.
My brother is married with 2 kids in India. He owns business.
My mother stays with my brother. My mother got B2 few years back. She never overstayed during her visit.
I invited my brother to visit us and also bring my son with him. He applied for visitor visa on the same basis. He applied only for himself and not his wife and kids as kids can't miss school.
His app. got rejected on the basis of 124(b).
    Questions asked:
    1) Why wife is not accompanying:
Ans: has to take care of kids going to school
    2) Have you travellled outside India:
    No
    3) Reason for visit:
visit my brother and bring his son back to USA
    4) Why can't his parents come to pick him up:
because brother can't take off from work, and his wife is going to school full time.
    5) Where does your brother work:
My brother tried to look my employment letter to get the exact name of my employer. He just wanted to make sure that he says the right thing. The VO asked him not to look at the papers.
    6) Details about my brother's employment (his business):
    Gave him details.
    7) Who will sponsor the trip:
    Me and my brother.

    --------------------------

Should my brother wait for sometime and apply with his entire family (wife and kids) ?
Or is there any other reason why his app got rejected . Should he try again.

    Thanks.

    The reason for denial is quite obvious;

Very casual and vague purpose of visit that does not sound natural for a busy businessman. ( Which businessman would leave his busy business to
travel all the way to US to drop off his nephew and for a casual trip to his brother).
And a pleasure trip is always natural for the whole family , not one person.

Please post honestly what his actual purpose of visit is; does he want to settle in US in future or is it just a pleasure visit?
For each purpose advice will differ.

      Thanks.

Thanks for your response. My brother was planning to come for 2 weeks. He has no intentions of settling in US.
The reason why he applied alone was because his wife and kids passport is expiring in June. We thought if we wait for their passport renewal it would be late.
My mother has the visitor visa for 10 yrs. She stays with my brother in India. She could bring my son , but she has health problems so she cannot travel.
I know that there are a lot of experienced people on this forum. If my brother applies for visitor visa with his family after few months, just for visit to the US, will they be able to get a visa. My brother and his family will have to go back soon because they will have to take care of my mom. My mom has been to US 2 times.

      Thanks again.
