  • Re-entering US after Visitor Visa Extension denial

First, thanks for all the great information on this forum and website. It helped me tremendously in the visitor visa interviews for both my parents and in-laws.

    Here's my situation now.

My parents visited me last year and their visa extension was denied in Dec 2007 and they left within the stipulated 30 days. The original I-94 was valid till mid Oct 2007.
Now, i want to bring my mom in May 2008. They have a 10 year mulitple entry visa.

Is there any restriction in the timeframe before which one can try to come back in the case of an extension denial? In this case, I am trying to bring my mom within 5 months after her last visit.

There are also numerous postings about 10 year visa being cancelled at the port of entry, when you come back after a visitor visa extension denial. Is that a case, if they had left within the given 30 days on their denial notice?

    Thanks!

She may be denied entry and section 222(g) of the INA enforced. Because she stayed past her I-94 date.

The 30 days after denial have to do with being deported... not with the visa being cancelled or not.

You won't and can not know what will happen until she tries to come, it is all up to the POE officer.
