    i was in J1 visa ( it expired on 1 October ) , but then i requested to EXTEND OR CHANGE NONIMMIGRANT STATUS.
    I need to leave at the end of this month but my case is still pending. Is this going to be a problem with my old I-94.
    On the form I-94 i have my entering date jun-5-2007, and J1, and D 13 (or 14).

    Your J1 I-94 would be valid as D/S -> Duration of Study

    A pending petition for Change of status fron J1 to other status like H1 will be approved even if you leave the country, but without the change of status. It is not very clear from your post what your situation is.

      thank you for responding !!!!
      i will try to explain everything with more details.
      i came here on student/exchange program work and travel.
      after that, i contact a lawyer for taking a tourist visa, i wanted to stay to travel and see my old friends;
      i have my flight for going back on 16 april.
      but my tourist visa process is still pending.
      i need to know, because when i come back to my country i will apply for a student visa
      is this going to be a problem;leaving the country like that?

        Your stay is authorized by the Attorney General when a decision on a pending application is not made by USCIS. You can travel outside the US and apply for a fresh visa. Just make sure you carry receipt of pending application with you just in case CBP is interested (not quite common) upon your return on a different visa.
