The title is not as complicated as what I am going to ask here. I hope some of you have had a similar experience.
I have a B2, and I asked for an extension of my visa 2 months ago. I know it will take some time before I get an answer from the USCIS.
However, I am getting married soon, to my boyfriend (who is on a J1), and I would like to apply for a J2 in order to stay with him in the USA.
I'm thinking of leaving the country as soon as possible, after getting married, to apply for the J2 at an american embassy in my home country.
However,
If I leave the country before getting an answer from the USCIS, when I come back, I might be considered as a "past" illegal alien at the port of entry, since my passport, and I-94 say I was supposed to leave the country on the 15th of february 2007...
I don't see why they would want to give me a second 1-94... Ocnsidering that the second time I tried to cross the canadian border, I was only issued a one month stay.
But then again, maybe I'm wrong, maybe I'm worrying for nothing.
My question is whether I should wait for an answer from the USCIS, then leave the country, ask for a J2, and come back.
Or, leave before I get an answer from the USCIS? Since, I would like to get a J2 asap in order to stay with my future husband.
