    Hi, i am a UK citizen and during my life i have been arrested twice, one leading to a fine of £60, the other led to nothing, released without any further action (wrongful arrest basically).
    i have been reading some websites and it would seem i do not qualify for the visa waiver program. is this true?
    If i was to apply for a visa which i think i may need to, how long does it last for because im traveling to the USA 4 times this year.
    my first trip is at the end of june, so i think it may be to late to get a visa and was thinking of going without. Would i be caught and what would happen if i was? any info appreciated. thanks

    When you go to apply for a visa, they will ask you why you do not use the vwp, and when you tell them about your history, they may deny anyway.

    I suggest, if you can afford it, try to enter on your visa waiver, they may
    even let you enter. If you are sent back, you can try for a visa.

      Just apply for the visa and appear for the interview. Depending on the crime you were arrested for, the offense may not be one that would have a negative impact on a visa. Like you said, you are not eligible for VWP.

        Not sure if his criminal record in UK will apply to his visa waiver.
        State dept website says criminal record, but I doubt a prosecution in UK
        will show up on a US computer at port of entry.

        If he applies for a visa mentioning his criminal record, it will go in his record for ever.

          Strictly speaking, the visa application just asks for arrests and convictions. It does not matter where, it has to be mentioned. The Criminal record from any country disqualifies one from using VWP.

          Just because the record will not show up at POE does not allow a person to use it. It will lead to other complications if a background check during AOS in the future or naturalization. Does not mean the OP has intent for this but hiding a material fact is never the right approach.

            I am going to the USA 4 times this year, and more in the future hopefuly. does this mean i need to book 4 interviews and get 4 visas? or does 1 visa cover it all?
            how long does a visa last?

              They can give you a 6m, 1yr , 5yr or a 10 yr validity visa. Upto the officer.
              You won't have a say in this.

              6m is a single entry visa and 1 yr/ 5yr/10yr are usually multiple entry visas.

              They usually give a 6m or a 1 yr valid visa to someone to see how he would use it. If you use it ok, without long stays or overstays, you should not have any problem getting another one.
