Marrying Usc

I have a B1/B2 visa valid until 2016. If my American girlfriend & I were to marry during a visit to US, could we apply for an I-130 ?..If so, would I have to leave the US on the exit date of my I-94. If we could apply for an I-130, what is the process ?...we have been dating for 3 years & want to marry as soon as possible.

I-130 alone does not give you a legal status in the USA. i-130 filed jointly with an I-485 allows people to adjust their status for permanent residency while in the USA.

However, entering the USA with a non-immigrant visa with the preconceived intention of adjusting your status is considered fraud and you should not follow this.
