  • DS-156 Line 38 Has Anyone Ever Filed an Immigrant Visa Petition on Your Behalf?

    My father is 66 years old and applying for tourist visa to attend my cousins wedding. My uncle who is US citizen applied for his green card 15 year ago in 1993 and thus my father received documents from the consulate in India to attend the interview for Immigrant visa in 1996, but my father didn't appeared for an interview and gave up the opportunity.

    So now my question is do we answer question number 38 as 'Yes' or 'No'. Appreciate you guy's response.

    Yes and take proof that he is no longer interested. Tough case for a visitor visa though.

        Strong ties in the form of property, family, culture to home country. Case status of the older immigrant petition if possible.

          It can be argued in favor of the applicant tht since he let go of one opportunity to be an immigrant legally in US, it proves that he does not have any immigrant intent. Be a little vocal during the interview.
