  • Second i94 before the first expires?

    Hello,

I'm travelling on a British passport (VWP)

Our first i94 will have the following days after its issue -
    62 within the USA, then,
18 days travelling through Canada towards Alaksa.

So once we reach the Alsakan border we will be 80 days since the issue date of the i94 visa, with technically 10 days left (90 day visa).

We would like to spend 28 days in Alaska - do you think they would give me a second i94 in order to stay in Alaska that long?

Is the 30days or more in Canada to be eligible for a second i94 a steadfast rule - or rule of thumb?

    Thanks

You need to apply for a visitor visa if your stay exceeds the 90 days allowed by the VWP. New I-94 is issued if stay is over 30 days outside in Canada but again it also depends on the CBP officer at POE.

You need to return the I-94 while you exit to Canada and cannot possess 2 I-94s at one time and get a new I-94 for Alaska. But if VWP gets you a 90 day I-94, you will have problems with your stay in Alaska.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
