  • B2 holder wants to adjust status

    Hello,
I read in one thread Praetorian mentioned that it can be considered a fraud if an alien under B2 get married to a USC and the USC file the I-130/I-485 as soon as the alien's arrival in the US. Question: when is the best time then to do so after the arrival? One week, two weeks, one month?
    Many thanks!!!

Get married no earlier than 60 days after arrival.
This is not a duration set by law but in general it is considered safe to override preconceived immigrant intent before arrival.

Despite this, you may face indirect questions at interview to determine if you had intent to marry when you arrived and to see if the marriage is real or sham. Be prepared to answer them correctly.

Some such questions are ; When did you both first meet?
Do you have any property/car at home and did you sell it when you came to US?
Did you meet your spouse's parents and vice-versa?

USUALLY , MOST PEOPLE DO ADJUST SUCCESSFULLY FROM B2 THROUGH USC MARRIAGE.

I think 90 days is the norm to convince them that it was not the intention before entry.
