  • HOPELESS young adult , HELP!!!

    Hello everyone-

    I am 19 yrs old and i was brought by my parents to the U.S at 12 with a tourist visa (all of us). We had only 6 mths of permission to stay and we did nothing to revalidate it for lack of guidance and financial resources. My visa expires in 2010. I attended school until i graduated from high school. I performed very well in school and want to continue to study. I attended interviews for schools with no success because without financial aid from the gov't its almost impossible to pursue a career. Most intriguing is that "who" assures me that in the end i'll have a job in this country because i don't have a S.S#. I don't want to get married (without love) with an American Citizen to become legal. It is risky and it is a looong process. Today, i feel so frustrated and need advice. Can someone help me please?

    P.S: I know there are Many hopeless young adults in the same situation as me out there, please help us...

    Visa expiration is irrelevant. So your I-94 expired probably 7 years ago and you have accumulated more than 6 years of "Unlawful Presence"

    You should consult an attorney.

    Not to scare you or anything but this is what I found on the the internet.

    (2) Counting of Unlawful Presence for Nonimmigrants. An alien who remains in the United States beyond the period of stay authorized by the Attorney General is unlawfully present and becomes subject to the 3 or 10 year bars to admission under section 212(a)(9)(B)(i)(I) and (II) of the Act. Under current Service policy, unlawful presence is counted in the following manner for nonimmigrants.

    (A) Nonimmigrants Admitted until a Specific Date. Nonimmigrants admitted until a specific date begin accruing unlawful presence on the date the period of admission authorized by the Service expires, as noted on the arrival document issued at the port of entry.

      The only way for you is to get married to a US citizen. It is not a long process, few months only. Do not leave the country as you will not be able to enter again as your visa is automatically cancelled because of overstay.

      I suggest you fall in love and get married to a US citizen, before they detect you , detain you and deport you.

        He did not start accruing illegal presence until he turned 18.

        But it has been 1 year or more since then, so 10 year bar is in place. There's nothing he can do to "legalize" himself. Other than AOS through marriage to an US Citizen.

          Thank you for the info. Actually, I had that doubt whether one could hold a minor responsible for this and it turns out NOT until the he/she reaches some age.

            Thank you all, but still unsure

            Thanks to everyone who tokk time to read and repply-

            I recently went to a lawyer and i was told that marriage to an American was the way to go. Also, it was said that a job contract would do, but right now they are put on hold until something happens. It is my understanding that if i got married in a couples of months i would receive my S.S# and the temporary residency in one and half year later, and in another 2 yrs i would get my permanent resindecy. Only till the permanent residency i can get divorced (if it's just for the doc). So, adding up the years it would be 3 to 4 yrs if i get lucky. Am i mistaken??? Could anyone explain to me how a job contract would benefit me??

              No job or employer can help you. You are here illegally and can not adjust status through them.

              Also, marrying "just for the document" (legal immigration status) is a fraud/crime. You also got the timing all wrong. This is an expensive and lengthy process where you must prove that you have true marriage.

              Desist your crazy ideas and go back to your country and start over. You will not find advice here on how to cheat the system.
