Parents 1-94 Departure date different

Hi,

My parents just cam to U.S. In my Dad's passport, INS official stamped till Dec 2008, But in Mom's passport stamped until September only. I think INS offical might have done some mistake.

What do i need to do now? Is there anyway contact INS about this? or just apply for extension for my Mom.

I don't know whether you can claim this as a mistake on the part of the POE officer because I think the I-94 for visitors are discretionary.

I would also suggest that you not apply for extension unless compelling circumstances exist as a visitor visa is for visit and not staying here for extended amount of time.

It is better if they return on time as extension, if filed and denied, voids their visa if they stay past their I-94 expiration date.

My dad got a different date and mom got a different date. They went to same peron at the same time. Definetly it is a mistake on INS official.

If i need to extend her stay, what do i need to do? Please let me know.

File for an extension. Instructions are on immihelp mainpage. Even if it is an error, you cannot say it is as visitor I-94 dates are discretionary at the POE. They could have asked then and there itself and it would have been easy to make the correction.

Again, be forewarned that if the I-94 does not get extended, there will be overstay recorded past the initial expiry of the I-94 resulting in future problems at POE and visa.

Perhaps the mistake was giving your father the 6 month I-94. It is quite arrogant of you to accuse the IO at the border of being wrong! It is a priviledge to get to visit the US; you have no right to expect that your guest receive the maximum allowable visit every time they come.

Perhaps they thought that your mother was coming to babysit and wanted to keep that from happening.

They should leave per the I-94.

I called CBP (US customs and Border protection) WWW. CBP.GOV. The person picked up the phone was very helpful. He told me to go to Philadelphia airport with my Mom to get corrected. He believes that was an error, since my dad got different date (6 months) but my mother got lesser time.

I hope this will help other viewers of this forum.

It is YMMV. It all depends on your luck at the deferred inspection office. Either ways, they might change it just out of being good but are not obligated to change the date.

Hence, cannot be taken as a given. Good luck and report your experience at the airport.

Yesterday i took my mother to Phili airport to change I-94 departure date. We went inside the office. One woman came collected my mother's passport. 10 minutes she changed I-94. It went smooth. No need to apply for extension.
