  • Aunt visiting need to extend B2 visa

My aunt arrived today and was given only 3 months of stay as stamped in her I-94. Before I posted here, I read the section in this website about extending B2 visa and it says not to apply for extension within 3 months of coming to US. So since she only has 3 months of stay, does this mean that she can no longer apply for extension ?

She has a 10 yr multiple visa and she was here last year to help us with our newborn, was given 6 months of stay and left Sept 2007. Today, the consul at the port of entry was not happy to see her passport stamped with trips to US almost every year. She's almost 70 yrs old , i don't understand what's the reason behind being strict on her length of stay.

Please advise if she can still apply for extension.

    Thanks in advance!

Because she lived in the US for half of the last year already and the rule of Visitor's visa demands that the visitor visits the US and does not lives in US.

Your application for extension will not be approved unless you really demonstrate a strong and valid reason.

She could have been denied entry and turned back for expedited removal as she is abusing the visitor visa and coming here to babysit and take away american jobs as per the law. You should be thankful that she was let in and be aware that next time such an abuse is noted, the visa will be cancelled.

The POE officer may even have put notes in the system about the frequent visit and this is just a check that she returns on time. If not, her visa stands a greater chance of cancellation due to such frequent visits to babysit.

OP, You are guilty of sponsoring someone to work illegally in the US. If you need your relatives to babysit, you need to return to your home country so that they can do so legally.

Your and your aunt's actions are no better than than someone who sneaks across the border to work. Both are ILLEGALLY working in the US.

Her visa should be revoked and she should be permently banned from ever entering the US. You should be punished for having an illegal worker.

        OBEY THE LAW!!!!!!

I didn't realize that ppl will think she's assuming a work of a nanny. I was on maternity leave the entire time she's with us. She was helping w my baby of course because my daughter is her grandkid and please take note she's 70 yrs old! The reason she frequently visits is it is cheaper for the family for her to come here than for us to go to my home country. I guess the ppl who responded don't have a sense of family.

thank you for your responses anyway.

And you don't have a sense of the law and disregard it quoting family values! What you are doing is nothing but abusing the system and using it to your advantage. People respond to posts considering the law on this immigration board.
