  • Legal for my parents to visit to take care of their grandson?

    Dear All!

I am a new member of this forum, so far I found it very informative. I have a question about my parents visitor visa. Actually I am going to start my Residency in USA from July 2008. I have recently come to US on j1 visa. I have a 2 yr old son and I want my parents to come and look after him for about 4- 6 months (till my husband can join me in US). I have advised my parents to apply for B2 visa. Now the question is, what shall they write in the purpose of trip. Can they say that are going to take care of their grand son (or is it illegal?). Shall they just say that we want to visit our daughter to help her settle down? Also , shall they say that we want to stay for about 4 months or just say that we want to visit for 4 weeks ( and then at the time of entry they say that we want to stay for 4 months)
They are able to support themselves financially, they also have property n job back home. they have one more daughter who lives in Canada and they will mention that they will visit her as well ( they have Canadian visa on their passport)
    Kindly advice me!
    Thanks

The legality of babysitting by visitors has been discussed here.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

You will need to plan to hire a babysitter or nanny or place you son in a day care center. That is what typical workers do in the US. You and your parents should obey US law, or they risk losing their visas forever. If you need your husband to babysit, your son should travel with him at the later date.

Do not come to the US planning to disobey the rules and regulations!

        Thanks for the replies!
I just wanted to know if that is legal or not, because I am new to this. I guess I will have to leave my kid with my parents back home..
I am going to have night duties so day care center cannot work out..and I cannot afford a full time nanny,,,,will have to pay her all my salary.

FYI - as backup to your husband -

Some hospitals have 24 hour/day child care centers since many of their late shift employees have child care problems that cannot be served by community based centers. In addition, they may have referrals to child care providers who will provide overnight care in their homes. Be sure any child care provider is licensed by the state in which you live.

Another option that is available is an au pair. This is done through an agency who arrranges travel/study for young - mostly women - from outside the US. Google that and you will find at least one web-site with links to agencies specializing in au pairs from specific countries.

thank you very much! My program does have child care, I will find out if it is over night or not...also if they have any opening for my kid...otherwise I will put his name in waiting list...Will also check out aupair.
