  • Visa B2 rejected

    Hi,

I would really appreciate some help with this.

My tourist visa application just got rejected for the second time, this time under section 214(b).

I'm 25 years old, graduated from college with a degree in computer science. I live in Tijuana, Mexico, I've lived here all my life. I have been working with my company for 2 years. Not married & still live with 3 of my sisters and my mom. My mother owns the house we live in. I'm make around 300 US dollars per week.

The interview went a little like this.

    Hi, passport and application

How long have you been working with XYZ company?
    2 Years.

    Do you own any properties?
    No.

    Are you married?
    No

    Who do you live with?
    My mom & 3 sisters.

    Does your mom have visa?
    No.

Can you please show me the letter from company XYZ?
    Yes

Then she read it for ... 20 seconds.... and said I'm sorry you don't have sufficient ties to your country....

And she handed me a letter explaining what 214b was.....

Can someone explain how she determined this?

I have bank accounts, social security, payments...everything ....

    No long experience with company,
No marital ties (married) and/or children,
Fresh out of college/young (25 years old),
No property in your name (living with your mom),
Not sufficient income ($300 a week).

But they ask you to have at least 1 year experience with your current employee & also when I was waiting for my turn the consul next to me awarded a visa to a guy who cleaned schools for a living he made 250 dollars a month ! My current payment is way above the average here in the US-MEX border.

Also I have a relationship with my fiance of 5 years and plan to marry her in the next 8 months.... I don't have properties but I'm currently looking for a home...

The thing is .... my documentation wasn't even checked she only asked for those questions .....is there are standard procedure?

Pretty much correct, I think. They don't bother about checking documents in most cases.

I was advised by a friend to seek help from a lawyer specialized in immigration issues....do you think this will change anything ?

It is a waste of money to hire an attorney. Is your fiance in the US?

                  1.- Buy products(groceries, computer parts, clothing,etc)......
2.- Go see the San Diego Padres ...I play amateur baseball and I've never been able to go to a professional game. Actually sports in general I'm big sports fanatic.
3.- Vacations. I wanted to go with her(fiance) to Six Flags ***** Mountain & Disneyland
4.- Skateboard in the US. There's like a gazillion skateparks just a across the border.
5.- Comicon ...every year around 20 of my friend go there...I'm the only one who doesn't.

Wait for another 6 months and give it a try again.
