  • 1 year stay in I94 for visitor visa.

    I just got a phone call from my friend in Irving(Dallas). He said 2 new visitors to USA got 1 year stay in I94. At POE, when the IO asked them how many months stay they want, they promptly said 1 year quoting the air fare hike and old age. They got 1 year stay.
    I am posting this information so that we can get more feed back on this.

      That is why I gave this information as soon as I got. May be USA is realising the hardships of old age parents visiting their sibblings. Let us hope we get more feed back on this.

        After I saw your post, did some research on this matter if it is possible as per the law. Did not find much info there.

        The Immigration and Nationality Act (INA) governs the admission of all people to the United States. For the part of the law concerning the admissions to the United States, please see INA § 212 and 214. The applicable regulations are found in the Code of Federal Regulations (CFR) at 8 CFR § 212, 8 CFR § 214, 8 CFR § 231, 8 CFR § 235, and 8 CFR 264.

        Was able to find some information in the IFM. It is possible as per the CBP Inspector's Field manual to admit a visitor for a maximum period of 1 year. No more extensions allowed past the I-94 granted.

        However, they also mention that this may be considered upon future entry by the visitor if they can be inadmissible due to spending more time in the country and abandoning primary residence. A visitor that has a 1 year stay granted is better if they leave without using the entire period and not return back without spending equal or more time outside the US.

          As you may know, I am in Delhi and have given a mail to my friend to know if the visitors who got 1 year stay have enterd in the same port or different ports and if they have entered on the same day or different days.
          Once I receive the informations, I will post the same for further discussion.
