  • What to do if married to LPR

    My friend is in China and she is married to a LPR. She is presently in China and wants to come to the US as soon as possible to join her husband. Her husband will be eligible for naturalization in about 1-1/2 year. She is talking to some people and they indicate that if her husband petition her now it would take about 5 year as LPR. When her husband become USC that they can change over to USC petition and the waiting time would be shorten to 2 years including the time that she has been waiting as LPR.

    Some are suggesting that she apply B-2 visa but there is a high chance that it would be denied since she has a high probablity of not returning to China.

    Some has suggested that she apply for F-1 visa since she was planning to study in US before she got married. Also very high chance of being denied

    Can someone provide some suggestions on how she should proceed on this?

    B2/F1 options are ruled out and if she lies on the visa app, it will do irrevocable harm for her GC and naturalization. The first two options are the only ones left.
