  • US CPA exam - VISA denied under 214(b)

    I was eligible for Colorado State in Jan'2007 ,had received NTS & everything was completed to sit for the exam except the visa . I am an INdian national , employed in Saudi Arabia as a senior finance professional, with a family resident visa since last 2 & half year , The US embassy Riyadh, Saudi Arabia had denied Visa under section 214(b). Can anybody answer the following?
    1) I had my academic qualifications evaluated by FACS, if I want to re-apply again to Colorado board, the same evaluation will be enough? Or I have to go for the evaluation again.
    2) Almost two years are over I was denied the visa for the first time , to re-apply for the visa again, shall I have to first apply to the Colorado board & get the NTS & visa letter again, OR I can re-apply for the visa with the previous NTS & visa letter from the CPAES-Colorado board.
    3) Any other suggestion for successful visa process. I am based in Jeddah, Saudi Arabia.

    Your visa was denied as potential immigrant - not on the basis of your credentials.

    You must first address how to overcome the lack of ties to your home country before you worry about any of the other issues.

      Seems you are a senior member of the thread, notwithstanding your negative tone in your replies to other thread, let me ask you, wheather the following facts sufficiently addresses the problem of ties to my " home" country or not

      Although I am applying from Jeddah , Saudia Arabia, I am basically Indian national & I am here since Dec'2005 with my family with a resident working visa, employed as a senior finance professioanl, my employer is sponsorong me for this CPA certification.

      I wonder, does the above address the "ties" problem ???

        I apologize if I seem negative sometimes. I become very frustrated by posters who don't do any research and ask questions that appear to be trying to scam US immigration.

        I am a citizen and take very seriously individuals looking for ways around the system that has been set up. It makes it very difficult for legitimate visitors to come. Members of my extended family were denied visitor visas a couple of weeks ago - and they were sponsored by a native born citizen and a person who has filed for naturalization. I know the problem is overstays from their country.

        I did not understand the your employer was sponsoring you for the exam. This makes it puzzling to me as to the denial. I suspect the the VO assumed the CPA exam to demonstrate that you were positioning yourself for a job in the US since the certification would not normally be something useful in either Saudi or India.

        I suggest that you work with your employer's immigration attorney to determine what documents might support the reason your Saudi employer would want to to have your CPA certification. For example, if your employer is a multi-national with a US based office with whom you must interface and collaborate on documents that would require the attention of a CPA in the US, it would demonstrate the reason for your rather unusual request. This is just an example of a possible situation. Only you and your employer can determine what demonstrates a logical explanation for your request. Again, I suggest that your employer's attorney be the best to assist you in preparing for your next interview.
