  • Will Mom get visa again.

My widowed mother had applied for and got a tourist visa (B2 ,validity one year) from the Kolkata consulate in May 2006. She went to visit her younger daughter (my sister) for six months and returned exactly 2 days before the 6 month period was over.I am her older daughter and I live in India with my husband . We are just 2 sisters with no brother. My sister and her husband are green card holders now but previously (when my mother had visited) they did not have it but were applicants.

My mother wants to go again this year in November 2008 for 6 months.
    My queries are:
What are the chances of her getting a visa again this time ?
Also, why do some people get a one year and others a 10 year multiple entry visa. Does it depend entirely on the whim of the VO or is there a reason ?
    Plz let me know.

One yr or 10 yr ; it is some whim and some situation. People who show weak ties may be given a one year visa. This is to see how the person uses it. One should not stay full 6 months on a one yr visa. It becomes harder to get another visa as the officer suspects the person likes it a lot there and may have an immigrant intent.

Now that she has stayed 6 months on her first visit, the next application , she should mention a shorter stay like 2-3 months. And she should show some engagement in India that will compel her to return or there are chances she may be denied.

Thanks for the reply. We'll apply for 3 months and see what happens.

Hi, Another point I want to mention is that previously my mother had applied for a visa for 4 months only. It was the U.S. immigration inspector at the port-of-entry who stamped to grant a 6 month duration stay.

For those who are interested :my Mothers first interview had gone very well. People in the Kolkata consulate were very helpful. The lady who checked her forms asked her on her own whether she needed a translater. Even though my mother knows a little bit of English I had adviced her to take the interview in Bengali because I was not sure whether she would understand English spoken with an American accent. The translater too was very kind and asked my mother to relax and answer normally before the interview started. The interview was short and the VO appeared friendly.
I hope the same people are there this time.

they give 6 month stay to most first time visitors. People with one yr visas should be smart and not use all 6 months but leave after 3-4 months if they want another 10 yr visa.

Her chances are 50/50... if she said 4 months on her visa interview, and stayed 6 months it does not speak highly of her.

She should mention LESS time, maybe 1-2 months and stay ONLY that much... In my opinion.
