    My friends Mom and Brother's visa got rejected.

    His mother is a housewife and brother student. The VO asked about husband's employment proof. They didnt had any as it was not mentioned in any of the requirement lists. There the VO gave a reason of "Not able to satisfy" and rejected the application.

    Few question:
    1. Is it OK to reapply and this time with husband's employment proof?
    2. If by chance the 2nd time the visa got rejected is it going to have any impact on future visa application as his brother is a student and in future might apply for h1/l1.

    Please let me know about this.

    Visit visa denials do not affect future L1s or H1s.
    Yes, it is ok to apply asap with father's income proof.
    Make sure income is high and his occupation stable.
    Also make sure the purpose of visit matches the duration asked for?

      yes my friend is sponsoring and the reason they gave for rejection is: "They are not able to support being dependents and there by can be potential immigrants"

      Any help or information on this regard please let me know

        Never ask a friend to sponsor. It clearly shows you are not well off in home country and the friend is helping you to settle there.

        Do you have any relatives there? On what visas?
        What is your home country?
        What is your dad's annual income at home?
        WHAT IS YOUR ACTUAL PURPOSE OF VISIT? DO YOU ACTUALLY WANT TO SETTLE THERE? MOM ALSO?

          actually its not for me.

          My friend only sposoring his mother and brother.

          I am not sure whether he has any relatives in us however he is in US on a H1-B.

          His home country is India. His dad's annual income is around 6-7Lakhs INR Per Annum.

              I am sorry, I first misunderstood the whole thing.


              Here is the advice;

              Your friend should first invite only his mother and not his brother.
              Young, single people, especially when they are showing sponsorship are more suspect not to return, so high risk of denial.

              If your friend's dad in India can show a total family income of 10 lacs /yr he should show self financing the trip of his wife. In this case, your friend should only send an invitation letter and no need of affidavit of support.

              If showing self financing is not possible, your friend should send an affidavit of support with invitation letter for his mom. Mom should only ask for a stay of 2-3 months, saying she is visiting her son.

              In both the cases she should show her husband's occupation and income
              papers. ( tax returns, salary slip if job, balance sheet if business).

                Is there any thing that can be done for his brother like any additional document. Or is it still advisable not to apply.

                In such a case if for instance he applies and it got rejected. Does back to back b2 rejections affect future L1 or H1 or F1 applications

                  His application with his mom may bring a denial to both like the first time.
                  So, it is advisable for mom to apply alone.

                  H-1 and L-1 are dual intent visas which means one does not need to show
                  non-immigrant intent like for a visitor visa. So, any number of visit visa denials will not affect H-1 or L-1 provided there is no misrepresentation
                  (false info) on a visit visa application.

                  Once mom gets the visa, we can talk about brother as well.

                  MAKE SURE THIS TIME YOUR MOM SHOWS ALL PAPERS FOR HER HUSBAND'S OCCUPATION AND INCOME.( GET A CA'S ASSET STATEMENT SHOWING FAMILY'S NET WORTH ALSO)

                    Thanks a lot for the inputs.

                    In case of DS 156 we have a section where in it asks "Whether US visa was rejected" We need to mark that as the visa was rejected during the 1st interview.

                    Do we need to carry the rejection letter and does the VO generally asks why the visa got rejected the first time and asks for document?

                    Its just that this time dont want to take any chances. Please let me know.
