I am so confused H1 & H4 Stamping at time....on 1 appiontment

    Hi Experts,

    I am in confusion.....

    My H1 visa(I-94 is valid upto Sep-30-2008) is going to be expired on Sep-30-2008. But I have new H1 approved copy(I transfered my H1 in Dec-2007, and i got my new I-797 approved copy upto Dec-2010).

    Now I am going to India in Feb-2009 and have plan to get married. After marriage i want to go for visa stamping...along with my wife....(i.e., for H1 & H4 stamping)


    I have following documents...

    1. I-797 approved pitition (upto Dec-2010)
    2. I-129
    3. A letter(mentioning my disgnation and salary with my experience with that company) form my employer
    4. last 12 months pay stubs
    5. last 12 months bank statements
    6. work experience letter(I have been working from Dec-2007 for same company)
    7.Income Tax return(W2)
    8. My company details.
    9. I-94(valid upto Sep-2008)

    Note: My current employer is USA company(Assets Management) and all my company empoyees are Americans.......

    Now my questions are......

    1) My visa going to be expired on 30-sep-2008. And i am staying here 5 months from after my visa expiration date. Will it create any problem at the time of interview in consulate? Because I think i will not have valid visa and valid 1-94.

    2) And how can proceed for stamping(both of us)? How can i add my spouse on same appointment?

    3) Are the above documents enough for interview? If not, please give me information about documents which i don't have?

    4). The current work experience letter is enough? OR may have privious work experience lettes also?

    pleaseeee help meeeeeeee..............

    How is it possible that all company employees are americans? What are you?
    Regarding your question, dont your company attorney help you?

    1. Did you new approval notice come with a new I-94? That will authorize your stay past the date on old I-94.
    2. You can both go together, there is an option when booking appt.
    3. See H1 section from homepage of this website.
    4. Carry all credentials, educational and experience.
