Student visa for a B2 visitor onshore?

  • Student visa for a B2 visitor onshore?

    I'm on B2 visitor visa in USA till Dec, 2008. I was wondering if it is possible to change my status to a student visa remaining onshore by taking admission into an eligible course. Or do I have to go back to my home country (India) and then apply for a student visa from India ?

    You should have declare this COS was your intent at entry. Otherwise, you need to return to your home country for stamping.

      Applying for student visa in home country is recommended.

        I had not declared this intent at entry. Is there still any chance of changing my status to a student visa while onshore. The reason I want to get a student visa is just to stay here for next few months until I apply for a H1b visa & didn't wanted to go back & wait for H1b in India. What would you guyz suggest in my situation.

          You should go back to the home country. Just getting a F1 status for the purpose of H1b is bad. If you apply for COS from B2, it has greater chances of denial and further H1b stampings etc will all become difficult.

          You seem to be looking for short cuts and there aren't any.

            You have to actually attend classes while on student visa. Non-attendance results in report to ICE and possible detainment and deportation.

            It is too late to enter school until January 2009. You may not work. I hope you have a lot of money in the bank if you carry out your plan.

            You have less than a 50/50 chance of getting H1B visa based on last years filings. Chance of approval of you H1B with your funny business is unknown.
