reg I-797 and 1-94 to apply for my parents visa

hi,

We are planning to apply for my parents visa sometime November end or in December 2008, and planning to get them here in US around May 2009...

Now my hubbys' visa is expired and his new I -797 is valid till Oct 15 ,2009, whereas his I-94 is valid only till march 2009.

Will that be a problem for my parents to get visa.My hubby is sponsoring my parents.

Please do advice. Thank you so much.
