change of status from visitors visa

Hi, I hv come from New Zealand with my wife+son on visitor visa - we are NZ citizens, born in India. I hv my parents/sisters who are U.S. citizens , is there any possibility to stay back here permanently.We have filed petition as married son this year.Our visitor visa expires in Jan'09.

I hv tried looking at F1 visa, but lot of time & money is invested/wasted if I go thru this F1. Any other option ???

Your parents can ...

... file for your permanent residency.

Use advance search in this forum and you'll get a lot of valuable information on what forms to fill, how much to pay and where to send the application.

If you do decide, you have to move on this right away and file the application ASAP, without wasting any moment.

You would not get a student visa as you have immigrant intent. You may find an employer to file for an H2B ot L1 if you qualify. There is no way for you to remain in the US; you will need to return to your home country until you have a dual intent work visa or your GC priority date becomes current. Do not consider overstaying because you will have to overcome many more hurdles to become legal in the US.
