  • planning to apply again for Mother in law's Visa

    Hello,

    My mother in law has been wanting to visit her daughter in USA. She has tried getting the visa three times but all the times she was refused under section 214b. all the three times the papers were well prepared. she has strong ties in India as her son (my husband), myself and even her younger daughter stays in India. Only disadvantage is that she is a widow.

    When she applied her daughterr was not working in USA now she has got a job and her one year old daughter goes to the daycare. She would again like to call my Mother in law to visit them in USA. her last rejection was in september 2008.

    Please advice us whether we should apply for Visa early next year or should we wait more. Please guide us in what to do which can ensure her the Visa.

    She may apply at any time. She needs to have changed circumstances or have identified what other information can be conveyed to the VO.

    Did she report being asked questions about her children in India? Does she live with or near you or help you with your children (if you have any)? Does she live with the younger sister? Are there any other family members who rely on her assistance? Is there any family event in the US that she would like to attend? Was her appointment in English or a regional language?

    Look through the archive for suggestions.

      the only circumstance that has changed from her last application was that her daughter whom she intends to visit has started working.

      all the queries that you have mentioned were done before but still VO was not satisfied and also refused to look at the papers. she stays with us. she does not have any property on her name and is completely dependent on my husband (her son). she is a housewife and since both of us are working she takes care of the house. her younger daughter also stays nearby. her language both the times was in english but she got a interpreter.

      please give further assistance as my sensibilities have almost failed to make sense of VO's decision.

        Won't fly ...

        ... the MIL needs to show much, much stronger ties to the home country and why will she actually return back.

        Changes in the destination country to this effect won't help.

          Your sister-in-law working works against your mother-in-law since many people bring parents for babysitting.

          I suggest waiting until a family event is scheduled in the US and seek a visa for a short visit (2 months or less) to attend that event. This could be anything from a religious ceremony to a vacation to Disney World or Washington DC or Yellowstone Park or ??? This may need to be done several times. Once she has demonstated that she will follow US immigration laws, she has a better chanvce of getting a long term visa
