  • I485 Change of address

    Hi,

    I have my 140 approved (EB2) and waiting for 485 approval.

    While approval on 485 is pending I have moved from Atlanta to a different
    state but never informed USCIS. I have my own house in Atlanta and thought I will get back there ASAP. But its now its almost one year.

    In the mean time I have got message that USCIS has transferred this case to ATLANTA, GA location to conduct the interview ( it also says that is a standard part of processing this I485).

    I am surprised why I am getting this interview message and also worried what I should do about the change of address.

    Any of you faced a similar kind of situation please share your experience and advise me the course of action.

    Did you not know that failing to file AR11 as an alien is a deportable offense?

      But the house in Atlanta belongs to me (I am the land lord, I just leased it to some body on temporary basis) and I wanted to get back there as soon as possible.

        You are still liable to file AR11, to let USCIS know the current address you are living at. Yes, failing to do that is a deportable voilation of law.

        Excerpts from my company intranet website:

        If an employee whose authorization to work in the USA has an expiration date (now or in the future), that is, the employee selected "An Alien Authorized to Work Until [date]" on his/her I-9 Form, and his/her home address changes while employed at YYYY YYYY X, that employee MUST complete the form below and submit it to the Department of Homeland Security (address is on the form).

        Under Section 265(a) of the Immigration and Nationality Act, all foreign nationals who are in the United States as non-immigrants or permanent residents are required to notify the Department of Homeland Security (DHS) of any change of address within 10 days of a move. In addition to submitting the required Form AR-11 SR, Alien’s Change of Address Card, to the DHS office listed on the form, it is recommended that the foreign national submit the form to the INS Service Center with jurisdiction over his/her state of residence.

        In short, each foreign national (including family members) must complete a Form AR-11 SR and mail the form via United States Postal Service certified mail with return receipt requested to the address listed on the form, and to the INS Service Center with jurisdiction over the foreign national's state of residence. Failure to comply is a violation of US immigration law and can result in removal of the foreign national.

          So, What would be the implication of filing AR11 now? What kind of questions I can expect in the I485 interview?

            Hi Freinds

            I have made this address change online at USCIS on 11/25.

            Today when I check the status the same is below.

            Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

            Current Status: This case is now pending at the office to which it was transferred.

            The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now pending standard processing at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you.

            Just want to understand what exactly does this mean.

            1. As per the previous status the case was transferred to Atlanta for a standard interview. Does this status change means the interview is cancelled and the case is transferred to Texas where I live now?

            OR

            Does it mean that its still with Atlanta office but no interview is necessary?

            Can some body who has similar ind of exp throw some light?
