  • Question about Visitors visiting US after 6 months stay

    Dear All

My in-law's got 10 year multiple entry visitor visa. When they came last time, they got only 3 months stamping on their I-94 departure card. Then I applied extension of visitor visa for another 3 months. They are leaving on Jan 20 2009. I want them to come back from India. Within how many months, they can come back?. Please advise either they can come after 2 or 3 months. Anybody has the same situation, please share your experience. Thanks.

    Regards
    Sankar

    They are VISITORS ...

... so they should VISIT United States and not live here.

    Get it?

They should plan on spending double the time they spent in US before coming back in their home country.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

My in-laws are still in visitor visa

My in-laws are still in visitor visa and they are only visiting US but not staying permanently in US. They never stayed beyond I-94 departure date. Please share your experience if anyone has the same situation. Thanks.

They got only restricted 3 months stay and you have applied for an extension. Have they got the extension letter? If so, your statement of staying within I94 dates is correct; otherwise it is wrong. If no proper reason is given for an extension (life and death situation) it is normally denied.
