  • Need help!!!

    During my mother's second visit (she left US in the month of July 2008 and re-entered on Dec 27th, 2008) at Chicago port of entry she has been allowed to stay for 30 days only on her I-94 departure card. I'm just wondering that any decision (rejection/approval) on her application for extension of stay (I-539) would affect her next visit in the future or validity of visa?

    Definitely. A denial of extension and stay past I-94 automatically cancels the visa. Higher rejection on future visa attempts and more scrutiny and shorter I-94s in the future.

    Send her back prior to I-94 expiration. She shoudl spend more time in home country than in US as per the unwritten rules.
