  • Stuck in bad situation need advice urgently

    I got my GC early this year and my wife has not yet got hers she is on her EAD. She is a house wife. Her I-94 expired in May 2004. I'm unemployed currently, and still trying to find a job.

    My wife is pregnant expecting in Dec 2004. We would like to have my in-laws (her parents) to help her adjust during the delivery.

    The issue is I cannot produce any employment letter or pay stubs, as supporting documents for their Visa. The documents I can send them are

    1. I-134
    2. Financial documents(bank statements, deposits etc.).
    3. My GC copy, and approval letter copy
    7. My wife’s EAD copies, 485 filing copy
    4. My and my wife’s passport copies
    5. Invitation letter to them
    6. Letter to consulate.
    8. My marriage certificate copy.
    9. joint filed Tax returns for previous years.

    Please advice if this will work to get them a visa.

    The other options that I was planning to opt for are
    1. My brother is also in US. he is employed on a valid H1 visa. his wife is on H4. Can he sponsor my in-laws? will it be any easier than my scenario?

    2. I can register a company in my name and then be the owner of it. can I use this scenario in any way to make it easier for them to get a visa.

    I tried searching for scenarios like mine but could not conclude if the advice worked. everyone please post what was the outcome of visa interview visit if the scenario matches by any angle.

    I would appreciate any help.

    1. It would be dificult if your brother sponsors your in-laws. It would be better if your brother sponsors your parents, your sister-in-law, brother-in-law etc. sponsor your in-laws if they are in US.

    2. That does not really work because the purpose of employment letter is that you are earning money. If you have your own company, how will it pay you money if it is not making any?

      unfortunately I do not have brotherin-law, or sister-in-law in US. so what is the way out. how do I go about resolving this situation, and get my in-laws to US.

      Please show out any pointers, that might help.

        Well it is really difficult situation as your brother is not related to your in-laws and you are not working.

          unfortunately it is a Bad situation as mentioned in the subject line. what would help is if some one could post their ideas/solutions/experiences in situation like this. I would appreciate the help.

            Just another idea....

            Just an idea:

            If your in-laws are financially well off, they might be able to apply for their visa as 'self-sponsored'....then they wouldn't need your documents..

            ..I'm guessing in that scenario the consulate officials would concetrate more on your in-laws papers rather than yours..

              Same situation here

              I totally understand your situation as I went through the same. I dont want to scare you but I am giving you facts about my parents.

              Both I and my husband are GC holders. My husband is in full-time school and I just left my job, searching for a new one. The visa officer rejected my parents' visa as they did not have I-134 with them. Even I tried to send my parents for "self sponsored" visa, showing their property value, bank statements, pension papers etc. But those papers were all taken out and none of them were sent to the visa officer except for our GC copies, bank statements and w-2 papers. So, I think I-134 and having a job is very important as they dont look at any other papers.

                Just a thought

                YOU are sponsoring in-laws, you need to submit evidences for your relation with them like marriage certificate. It is not mandatory to submit your wife's
                lNS documents. Your legal status is enough.
                To prove your financial strength savings, stocks certificates, any properties,...etc enough.

                So just go ahead and ask your in-laws to submit only required documents.
                Any other documents like your wife's I94, I485 in progress may unnecessarily
                raise concerns.

                By the way in the form DS156 (application for visa, need to submit at consulate) asks for any family members currently living in US, for which your in-laws can't lie (they can but it is very risky for you and for them) so sponsiring anybody otherthan you might raise very serious issues.

                FYI - Checking these forums sometimes raise unnecessarily concerns but there are thousands of people who didn't really get any problems, you may belong to that group. Good luck.

                  Forgot to add an imp point to my last posting

                  You are now on GC, so no need to submit any documents(like paystubs) to prove an employee and employer relation like in H-1B1. You can be without
                  a job, as long as financially strong you can sponsor people.
