  • Applying for B2 visa for slightly different reason; what are the chances for success?

    I am a dual US and Romanian citizen trying to get my soon to be wife from Romania to visit the US temporarily. I want her to experience my last semester of college with me as well as have her present at my graduation along with my family. For personal reasons, we plan to marry in Romania shortly before she applies for a B2 tourist visa. She is applying for the tourist visa because right after i graduate, both of US intend to return to Romania permanently to live there. Am I applying for the right visa given my intentions? I have also thought about starting the Petition of an Alien Relative Form I-130 in the US for her, as I am legally eligible since the marriage is NOT out of interest. The key is that I do not know if the last option then obligates you to remain in the US, as we both do not want to stay. Either way I am worried about how the immigration officer might misinterpret this since A) as the marriage is closely spaced to the interview it might 1) seem as a setup to obtain the visa with **** intentions and 2) that her marriage to me may make it seem as a social tie in the US that is even stronger than the one with her home country, to where she will not convince the immigration officer that her visit really is temporary in nature or B)that if I do apply for the I-130 and then leave the US as we intend, to not have it count as fraud on counts of desertion. What advice can you offer; is there any specific supporting documentation I can bring to prove my case beyond a doubt for the B2 visa? should I still apply for the B2 visa or something else? What can I do to prove that I am planning to return with her as well? Or worst case scenario, is there anything in terms of my marriage plans that I can change/put off at a later date to prove our honest intentions beyond a reasonable doubt?
