  • Visa rejection due to extension during last trip

My mother's visa got rejected at Chennai. The letter says 214 but the officer stated that because she had extended her visa during her last visit, so they were not sure she will not extend it again.

She came in 2001 with 6 month visa. After 4 month she applied for extension. Got the extension for another 6months. She stayed for another 5 months (total 11months). So everything was legal and on time. She was not out of status and went with still 1 month left.

The officer initially asked her to come with her original extension papers. Next day she went with all relevant documentation - Extension receipt/approval, copy of 539 application, copy of original I94, passport stamp that shows when she left etc.But next day he rejected her. I am not sure why he even asked her to come back with relevant papers if he was going to reject.

Does this mean you should never extend while on a 6 month visa? I was wondering what others had experienced when visa was extended and they applied the next time at consulate? Also, what are some of the valid arguments for extension that can be used for future interviews. (I had just used tourism to get extension approved in 2001)

In laws extended during last visit but extension was rejected so they went back with a few days. Then they applied again in Mumbai after 3 months and they got 10 yrs visa. They were grilled but they passed the interview process.
