Renting an apartment to visitor

Good Afternoon:

I have a person who is looking to rent an apartment in our apartment community. The person has a current and valid visitor Visa and has applied for a worker’s Visa to stay and work in the United States.

My question… Can this person rent an apartment with only possessing a visitor Visa? I believe the law states that a person with a visitor Visa cannot obtain employment; therefore I would think that they cannot establish residency – i.e. rent an apartment.

Please advise.

Whether you would like to rent an apartment to a visitor or not is entirely up to you. There is no immigration law that prohibits that.

The person on visitors visa can't work, but if the person changes his/her status to some work visa, he/she can work.
