    Hi everyone,
    I got naturalized last year. I have an out of wedlcok son back in India. I never mentioned him during my green card and citizenship process due to the fear of my wife here. Now that I am a citizen, I did tell her. She is not too angry about it. She is open to me bringing him here. He is 13 now. I have been paying for his school and stuff so far from the money I send to my father. He lives with my parents too. The USCIS seems to want me to provide me the proof of father-son relationship. I have my name on his birth certificate. I visited him last year after 9 years. I talk to him when I call my parents. Since we get to talk on the phone twice a month at least, I do not write to him. How tough it would be to bring him here? Is the USCIS gonna be tough on me for not mentioning him in my previous applications to them? I know I have to file for I-130 first, but how tough would it be for him to crack the interview in Delhi once it gets sent to Delhi? If u have had any prior experiences, I would love to hear from you. I would also appreciate any information and suggestion from legal experts on this as to how to expedite his coming here. Thank you in advance for the time and consideration.

    Hats off to your courage and your wife!!!

    I have not come across cases like yours but USCIS would want proof of relationship and proof that you have the right to keep your son with you - judicial custody. Where is his mom? Is she ok with he coming here or what?

    I dont think USCIS will be tough on you on his immigration process but may pull you up for not providing information about him in all the previous documentation.

    Wait for more responses also.

      His mom is in India too. Since our family is taking care of the kid totally, I should have the custody. She would not object to me bringing him here at all. Is the consulate in India gonna ask for DNA and stuff? Don't get it why they would be tough on me for not mentioning him earlier during GC and naturalization though.

        No need to go that hi-tech. A birth ceriticate with your name as father should suffice. Or some other similar proof.

        For custody, you must have documented proof if they ask.

        They will be tough on you for lieing on all documents you filled, for witholding information. I dont know why ppl think its ok to just hide information or falsify.

          There are instances when consulates have asked for DNA in such cases.

          I see one issue with your naturalization in the first place. If there is any material fact hidden during the naturalization process in the applications, it is a perjury and they can strip your USC for lying on the forms.

          You need to consult an attorney.
