  • married to GreenCard... what next????

    hello,
    i got married to a greencardholder recently. But am in US In B2 Visa which is valid till june 2009. Now my husband is planning to file I-130 for me...my Question is after filing I-130 1)what is the next step we need to do??
    2)Can we apply I-485 and EAD??IF YES..when
    3) what status i will have after filing these and is is legal????

    or if you have any better options..PLEASE share!!

    1) You can not obtain anything... not EAD, not AP, not even file i-485.
    2) You can not get ANY legal status from him filing an I-130 for you.

    You must wait 5-6 years after the I-130 is approved for you to be able to receive a green card through him.

    So, basically you are out of luck, you can not stay in the USA based on your B2 visa for longer than the time allowed on you I-94.
