Can we apply for Visitor Visa (B1/B2) who is currently holding R type Visa (R/P3)

Hi,

I am in L1-B visa and i wanted to know whether i can apply Visitor (B1/B2) VISA for my father .My father is currently holdiing US VISA type R, Class P3. His Visa expiry date is 15-Aug-2009.

Do i need to apply only after his current visa expiration? Is there any possibility for Visitor VISA rejection even i apply after his current visa expiry date.

Please advice.

Thanks for the reply. i wanted to know the possibility of his VISA rejection by considering him as "potential immigirant" based on the "R" VISA which he is currently holding.
