I94 validity

Hi,

I am currently working on H1B visa and my I94 got expired on 5th of April'09. Extension has been applied and got the receipt as well, but approved petition not yet received.

Now I am planning to apply visitor visa for my parents, can i apply now with receipt or have to wait till i get my approved petition. Thanks in advance.
