  • Aged Mom_in_law visa

    Hi all,

I am married and staying with my husband in California since last 4 years. We both have a green card. My husband is here from past 11 years and he has not got his mother to USA at all. Now I am thinking of getting her to USA.

His mother is a widow and she does not have any property in India. She does not have a house in her name, but she has a site in her name. Does this mean she can show that document as proof when she applies for visa? But she has bank statements, birth certificate etc. She is not working now and she was not working before. She is above 60 years of age.

When ever I ask my husband, he just tells me that there is no way she will get a visa because she does not have a own house nor she is working. US consulate might say that she might not come back to India because of this reason. he tells that he will get her here when we get our US Citizen ship and his mother will then get a green card. But that is going to happen in 2005 December. I want her to come here before that. My husband is her only son and she is living all alone in India,

Can anyone guide me or advice how I should proceed in getting her here? What documents will satisfy US consulate at chennai? Please let me know if there is such a similar case what I have described above. Any help will be appreciated.

    Thanks in advance.

There is no specific rule that will ensure visa. You will not know whether she will get visa or not until she applies. You can just try your best.

Show whatever property such as site etc. that she has.

    Good luck.

I appreciate your good sentiment to get your mom-in-law to US. But, beti, I am sorry to say that these Consulate people are very whimsical and we have to totally rely on our luck as far as this visa is concerned. I am a parent with both my children in US; we both [the parents] have house property in India [one in the nameof each of us] and other investments etc. We both are pensioners having monthly income in India. But we were refused visa twice for the reason that we have both our children there in US and that we both are retired.
So your husband's reasoning is right.......however, by a stroke of luck, your MIL might get the visa......if the consulate officer has a humane heart! Best of luck
